The Committee on Industry and Labor and Economic Development
and Small Business moves to amend the bill on page four, section
eleven-a, line two, following the word "section" and the period by
inserting a new subsection (d) to read as follows:
"(d) Limitation of actions - Notwithstanding any other
provision of law to the contrary, except as expressly provided in
this section, no civil action may be filed by any purchaser or
owner of a manufactured home seeking monetary recovery or damages
for claims related to or arising out of the manufacture,
acquisition, sale or installation of a manufactured home, more than
two years after the date of purchase of the manufactured home.
Nothing in this subsection may be construed to limit or restrict
federal or state administrative actions available to the consumer
or claims based upon individual warranties.".
